THE RIGHT TO BE FORGOTTEN: A COMPARATIVE ANALYSIS BETWEEN BRAZILIAN AND EUROPEAN LEGAL SYSTEM

The right to be forgotten is a significant topic in data protection and privacy. This study compares Brazilian and European legal systems, examining the application and interpretation of this right. The research problem focuses on tensions between privacy and freedom of expression, highlighted by conflicting court decisions. The objective is to explore the philosophical and legal foundations of the right and its legislative developments. The study concludes that while Brazil's LGPD faces practical challenges, Europe's GDPR provides clearer mechanisms. Despite differences, there is a global trend toward harmonizing data protection and privacy practices.
