PATHS TO POLYAMOROUS COMMON-LAW MARRIAGE RECOGNITION: AN ANALYSIS BASED ON THE CNJ DECISION AND ITS EFFECTS AND PERSPECTIVES FOR THE LAW

This article discusses the recognition of stable polyaffective unions in Brazil. In the legal field, the definition of family has changed to include several configurations beyond traditional marriage. In 2012, a registration of a stable polyamorous union at a registry office between a man and two women in São Paulo marked a significant step towards this demand. This fact was taken to the CNJ, which denied the possibility of legal recognition of these unions, stating that monogamy is a structural principle in Brazilian society and that there is no legal provision for polyaffective unions. The debate reveals a tension between the need to protect new forms of family and the limitations imposed by current legislation. This article explores the argumentative paths of the votes and memorials that led to this decision and points out possibilities based on these discussions.
